Live Nation and Ticketmaster are asking a federal judge to throw out the blockbuster antitrust verdict against the companies — or at minimum order a new trial — arguing the case was tainted by inflammatory evidence, flawed jury instructions, and legally unsupported findings.
In a 36-page motion filed Thursday in the U.S. District Court for the Southern District of New York, the concert giant said the jury’s April verdict finding the company liable on all claims was “legally indefensible” and “against the clear weight of the evidence.”
The filing marks the latest escalation in the closely watched antitrust battle brought by a coalition of state attorneys general and previously joined by the U.S. Department of Justice. A jury sided with plaintiffs last month after a 25-day trial centered on allegations that Live Nation used its dominance in concert promotion and ticketing to stifle competition.
